Introduction

To ensure the best experience for all our customers, we have implemented a few rules and regulations for our services. It is important that you follow these guidelines, so we have made them as clear, concise, and easy to understand as possible. In this document, "your service" refers to any service you have or rent from us. "We" refers to CraftLands Hosting.

If you have any questions after reading our Terms of Service, please reach out to our support team for clarification. While we aim to provide reasonable notice for major changes to this document, it may not always be possible. Therefore, please check back frequently for updates.

By purchasing any service from our website, you agree to comply with our Terms of Service. We reserve the right to cancel, suspend, or terminate any service, with or without notice, warning, or refund, for any reason. We may also modify our Terms of Service at any time, with or without notifying the client. It is the client's responsibility to periodically review the most recent Terms of Service. If a client fails to comply with the updated Terms of Service, their service may be terminated at our discretion.

General

02. General Terms

Use Common Sense: If you suspect that an action might lead to trouble, it likely will.

Termination Policy: We reserve the right to terminate any service at any time without the possibility of a refund, though we hope this won't be necessary.

Terms of Service Updates: Our Terms of Service may change at any time. It is your responsibility to stay informed about these updates.

Legal Use: Do not use our services for activities that are illegal in Italy or your country of residence.

Service Disruption: Do not use your service to disrupt or interfere with any other CraftLands Hosting service or any other service on the internet.

Age Requirement: You must be at least 13 years old to use our services.

Parental Consent: If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use our services. Make sure they review this agreement with you.

Minecraft

03. Minecraft Terms

General:

By purchasing a Minecraft server from our website, you agree to follow Minecraft's Usage Guidelines. If your server is found to be in violation of these guidelines, it may be suspended until the violating content is removed.

Fair Use Policy

04. Fair Use Policy

Our services don't have strict bandwidth limits, but there are some restrictions:

  • Content Restrictions: Hosting hundreds of copyrighted music, movies, or games is not acceptable.
  • Bandwidth and CPU Usage: If your service uses an excessive amount of bandwidth or CPU for prolonged periods, you will receive warnings via email or Discord. Failure to address the issue may result in service suspension.
  • Disk Space Usage: If your service is using excessive disk space, we may investigate your storage. If we find excessive disk space used for material unrelated to your service, you will receive warnings via email or Discord. If the issue is not resolved, we will begin deleting files unrelated to your service.
  • Fair Use Policy: Exceeding any terms of our Fair Use Policy may result in the removal of the infringing files.
Payment

05. Payment Terms

Service Activation: Services will not be activated until the first payment is received.

Renewal and Grace Period: If you do not renew your service before it expires, you have a one-day grace period to pay the overdue invoice without any service disruption or penalties. After this period, your service will be suspended until payment is made.

Termination and Deletion: If payment is not received within seven days, your service will be terminated, and your files will be deleted from our servers.

Chargebacks and Disputes: Any chargebacks or payment disputes will result in immediate account suspension. If you encounter any issues, please contact support, and we will assist you in resolving them.

Scheduled Payments: We offer the option to set up scheduled payments to automatically add credit to your account at your specified frequency. If you choose to schedule automatic payments (e.g., PayPal subscription), these are linked to your account, not to any individual service.

Account Credit: Account credit is non-refundable and non-withdrawable.

Refunds & Disputes

06. Refunds & Disputes

All refund requests must be submitted via a ticket on our website or Discord.

To request a refund, you must be logged into your client account. If you are not logged in when submitting the ticket, we cannot accept it as a refund request. In such cases, our support team will ask you to log in and resubmit the request. You will have 48 hours from the time of our request to log in and request a refund.

When logging in and opening your new request, you must reference the original ticket ID from the ticket created while not logged in, if the initial 72-hour period has passed. If you fail to provide the ticket ID, we won't be able to locate your original request, and no extra time will be granted.

If the client opens a dispute, we reserve the right to suspend any and all of the client's services.

All setup fees and dedicated servers are non-refundable.

All refunds will be provided as credit or via the original payment method at our discretion. When a refund is issued, any related services will be terminated.

72-Hour Refund Policy

07. 72-Hour Refund Policy

Eligibility: Refunds can be requested within the first 72 hours of ordering a new service. To be eligible, you must explain why you wish to cancel and receive a refund. Each client is only eligible for the 72-Hour Refund Policy once.

Refund Requests: Submit all refund requests via our website or Discord. The 72-hour period is calculated from the time of order to the time the request is submitted. You may be asked to provide a reason for your refund request, which will not affect your eligibility.

Client Response: If we contact you for additional information or confirmation, you must respond within 48 hours. Failure to do so will void your eligibility for the 72-hour refund.

First 72 Hours Only: This policy only covers the first 72 hours after a new plan begins. Refunds for service renewals are not eligible under this policy.

Single Transaction: The 72-hour money-back guarantee applies to a single transaction per client account. Creating multiple accounts to claim multiple refunds is prohibited and will result in denial of the refund.

Disputes: Opening a dispute on any payment will void your eligibility for the 72-hour refund policy.

Service Completion: If a Server Management request has been fulfilled, you immediately lose eligibility for the 72-hour refund.

Multiple Accounts: Clients found creating multiple accounts to claim refunds multiple times will be denied refunds.

Payment Methods: Some payment methods may not support refunds, as determined by the payment gateway. In such cases, the refund will be issued as account credit.

Timely Responses: To maintain refund eligibility, you must respond to all messages from us (including automated responses) within 48 hours. Failure to respond within this timeframe will void your eligibility, unless you are still within the initial 72-hour period from ordering the service.

If you retract your refund request or do not confirm the refund within 48 hours of our request, the request will become void. You can submit a new refund request, but it will only be eligible if the 72-hour period from the original order has not passed.

EU Right of Withdrawal

08. Waiver of Right to Withdrawal (EU Customers)

If you are a customer residing in the European Union, you have the right to withdraw from a purchase contract within 14 days under the EU Consumer Rights Directive. However, by purchasing our digital services, you expressly agree to the immediate commencement of the service and acknowledge that you waive your right to withdraw from the contract once the service has begun.

This waiver does not affect your rights under our 72-Hour Refund Policy. You may still request a refund within the first 72 hours as outlined in Section 07.

By accepting these Terms of Service and proceeding with the purchase, you consent to the immediate provision of the service and agree that you lose your right of withdrawal under the EU Consumer Rights Directive once the service has started.

Overpayments & Accidental Payments

09. Overpayments & Accidental Payments

We recognize that overpayments and accidental payments can occur and are committed to resolving these issues with you.

Clarification on Payment Types:

  • A payment made by the user is not considered "accidental" and will be handled according to the "Refunds & Disputes" section.
  • An "accidental" payment refers to a manual payment made by the client that was not due, such as making multiple payments for the same invoice. These are termed "overpayments."

Definition of Overpayment:

  • An overpayment happens when an invoice is paid more than once. When this occurs, the overpaid amount is added to the client's account as credit.

Conditions for Refunds on Overpayments:

  • Timely Requests: Refund requests must be made within a reasonable timeframe. Payment processors like PayPal have time limits on refunds, so make sure to submit your request within 7 days to ensure we can process it. Requests made beyond this period may not be eligible for a refund.
  • Account Credit Usage: Our system automatically adds overpayments to your account as credit. If any of this credit is used before a refund is issued, the refund cannot be processed.
  • Multiple Overpayments: Refunds for multiple overpayments will only be issued for payments made within the last 30 days at the time the ticket is handled. Therefore, it is important to open a ticket as soon as possible.
  • Unused Credit: The credit must be unused and remain in the client's account for a refund to be issued.

Refund Request Details:

  • When requesting a refund for an overpayment, please provide the PayPal email or equivalent payment method information used for the overpayment, along with the date the payment was completed. This will help us locate and process your refund efficiently.

By following these guidelines, we aim to resolve overpayment issues promptly and effectively.

Cancellations

10. Cancellations

If you decide not to continue with your service, please follow these steps:

  1. Submit a Cancellation Request: Log in to the CraftLands Hosting client area and submit a cancellation request for your service. If you need assistance, our support team is available to help you.
  2. Cancel PayPal Subscriptions: If you've set up PayPal subscriptions for automatic payments, you'll need to cancel them directly through your PayPal account. Since CraftLands Hosting does not have access to your PayPal account, we cannot manage or be held responsible for any incidental payments made through the automatic payment subscription service.

By taking these steps, you can ensure that your service and any associated payments are properly canceled.

Violations

11. Violations

Enforcement of Terms of Service:

  • Discretionary Notices: For certain violations of our Terms of Service, we may choose to send notices or warnings via email or support ticket. However, this is entirely at our discretion.
  • Consequences of Violations: Any violation of these terms can lead to the suspension, termination, or closure of your account, without the possibility of a refund.
  • Exploitation Attempts: Any attempts to exploit any part of our system will result in immediate account suspension, termination, or closure, also without a refund.
Abuse

12. Abuse

To report abuse on the CraftLands Hosting network, please contact us.

Any abuse complaints concerning your service will be promptly forwarded to you for immediate attention. We may suspend your services until these complaints are fully addressed. If the investigation confirms the abuse report, your services may be terminated.
